Divorce Eligibility Calculator

Enter a few key dates to see an estimated separation date and whether the usual twelve month requirement is likely to be met before you apply for a divorce. This is general information to help you plan, not confirmation that you are eligible.

The day you and your spouse separated, even if you continued living in the same home.

Estimate

What you can do next

An estimate is a useful starting point. A conversation with one of our family lawyers will confirm where you stand and guide you through the application.

General information only. This calculator provides a general estimate and is not legal advice. Eligibility for divorce depends on the full circumstances of your matter, and the court considers a range of factors before granting a divorce. Figures and dates shown are a starting point for discussion rather than confirmation of any outcome. Please obtain advice from a qualified family lawyer before making any decisions. Liability limited by a scheme approved under professional standards legislation.

Understanding the Rules

In Australia, the sole ground for divorce is the irretrievable breakdown of the marriage. This is demonstrated by a 12 months and one day of separation.

Separation under one roof: It is possible to be separated while living in the same home, provided you can demonstrate that the relationship has ended (e.g., separate finances, sleeping arrangements, and public representation).

Legal Disclaimer

This calculator is a tool for general information and planning purposes only. It does not constitute legal advice and does not create a lawyer-client relationship.

The results are based on the Family Law Act 1975 (Cth) requirements for a 12-month separation period prior to filing for divorce.

While we strive for accuracy, individual circumstances (such as contested separation dates or complex reconciliation periods) can affect legal eligibility. We recommend a formal consultation with a family lawyer before taking legal action.
